Privacy Policy

This Privacy Policy (hereinafter referred to as the “Policy”) explains how “SIMPLER GROUP LTD” with registered seat at 128 City Road, London, United Kingdom, EC1V 2N, including its Greek subsidiary company “Simpler Single Member P.C",” (hereinafter referred to as “Simpler”, “we” or “us”) processes your personal data (hereinafter referred to as “Data”). 

Simpler is the Data Controller for the processing of personal data received through the use of the Website and for Simpler Checkout Services by its Users, in accordance with the General Data Protection Regulation 2016/679 of the European Union (hereinafter referred to as "GDPR"). In this Statement, we provide you with information regarding the type of personal data we collect, how and for what purposes we collect it, the third parties with whom we share this data, and your rights.

1. Services

Simpler offers a streamlined online shopping experience, allowing you to check out with just one click and without the need for a password. We make the buying experience fast, secure, and straightforward across hundreds of retailers and through various channels. Through a Simpler account, you can manage all your orders from a centralized dashboard. While Simpler is essential for online shoppers, it also serves as a valuable tool for businesses aiming to enhance their sales by providing customers with an exceptional shopping experience, enabling them to check out in seconds from anywhere. For the purpose of this Statement, “Simpler Service” or “Simpler Services” refer to proceeding to purchases via Simpler Checkout as a registered user with Simpler.

Simpler also offers a specific service, the “Checkout Takeover Service”. This specific service refers to situations where Simpler Checkout is not offered as an additional payment option, but instead becomes the primary checkout method provided by the Seller. In this case, Simpler Checkout replaces the Seller’s own checkout and becomes the main option for completing transactions. In that case, Shoppers have the option to either register with Simpler (and be treated as Users) or proceed to Guest Checkout, without registering with Simpler. Guest Checkout is only available in Checkout Takeover partnerships. In any other cases, the Shoppers shall register with Simpler to use its Service, according to Shoppers Terms and Conditions.

2. About the processing

Simpler acts a Data Controller for the processing of personal data of;

  • its website visitors, and
  • all individuals who are registered with Simpler (hereinafter “Users”)

In that case, Simpler transfer personal data of its Users to Sellers, who act as Data Processor for the sole purpose of placement of orders and delivery. The Seller is Independent Controller for any additional processing beyond that scope. 

Simpler acts as a Data Processor with regards to the provision of the specific service “Checkout Takeover” and the Seller as a Data Controller.

3. Types of personal data we process

In both cases, either using Simpler Services or the Checkout as a Service (CaaS), we process the following personal data:

- Name, Surname, Phone, email, postal address;
- Payment card number, CVC code, expiration date, which are encrypted in accordance with PCI DSS standard by our authorised payment service provider;

Simpler will not collect or retain any of your payment information which is included but is not limited to your credit or debit card number, bank account details. 

- Purchase amount, currency, purchased product and size, date and location of purchase;
- Transaction and purchase history;
- Cookies, IP address, browser, account log-in credentials, device type, location data;

The above-mentioned data is necessary for the provision of Service and Checkout Takeover.

4. For what purpose does Simpler process your data?

When using Simpler Services, we process your personal data:

  • To register and manage your Simpler account;
  • To store information about you in connection with Simpler Checkout and streamline your checkout;
  • To fulfill the orders and the returns you make via Simpler;
  • For the proper functioning of our website;
  • To answer the questions you submit via the contact form;
  • To satisfy the requests, regarding the exercise of your rights, that you submit either via our website;
  • To improve our services;
  • For crime and fraud prevention, detection, and related purposes;
  • To contact you electronically about promotional offers, events, products, and services which we think may interest you.

When using the Checkout Takeover, we process your personal data as Data Processors, following the Seller’s instructions, acting on behalf of the Seller, in the context of our contractual agreement with the Seller.

5. Why do we process your personal data?

In the context of using the Website, the Company processes your data in accordance with the following purposes and lawful bases:

Α. Legitimate interest

In order to safeguard and achieve the Company's legitimate interests, the Company processes the personal data concerning you mentioned above in order to ensure the uninterrupted, correct and secure operation of the Website, to keep data backups and to ensure business continuity issues in general.

Also, based on our legitimate interest, we manage any general communication we receive from you to ensure that we respond promptly and effectively to any request or query you make to us when you submit a contact form through the Website or our other official channels.

B. Contract

If you are a Simpler User, we process your account’s personal data in order to provide you with our services. Part of our services is to inform you about relevant offers you might be interested in. You have the right to select the "unsubscribe" link at the bottom of each such communication, or by sending us a request to the contact details indicated in the relevant section below.

If you use Guest Checkout, we process personal data in the context of our contractual agreement with the Seller.

C. Consent

For Shoppers who wish to receive newsletters and/or important corporate announcements from us, we will process their full name and the e-mail address to send them offers,  news and updates about the Company and/or other Group companies. You have the possibility to withdraw this consent at any time, either by selecting the "unsubscribe" link at the bottom of each such communication, or by sending us a request to the contact details indicated in the relevant section below.

In addition, if you give your consent to the use of technologies such as cookies, information about you is automatically collected in accordance with the Website's Cookies Policy for analytics, personalisation and/or advertising purposes. You can change your cookie options and withdraw your consent at any time through the Website's Cookies Policy.

D. Legal Obligation

We are obliged to process your requests for the protection of your personal data and overall to comply with any requests for personal data we receive from relevant police, judicial or other supervisory authorities.

6. Who do we share your data with?

In order to best fulfil the above processing purposes, the Company may share personal data with the following categories of its partners:

  1. To manage your User Account, we transfer your data to:some text
    1. Technical Providers (such as Software Fault Detection Providers for troubleshooting purposes, Data analysis)
    2. Server and Cloud Service Providers 
  2. To process your purchase, we transfer your data to:some text
    1.  Sellers, acting as Data Processors to fulfill the purchase;
    2. Third party Payment Providers: Simpler engages payment service providers at its sole discretion in order to streamline checkout. Simpler may suspend, modify, or change any payment service provider at any time. The current payment service providers (hereinafter “Payment Service Providers”) are Bluesnap and Antom and they process your data under their capacity of payment providers to enable your payment.  
  3. If you choose another Payment Method such as Klarna, Google Pay, Apple Pay etc, we may provide them with your data related to the transaction (e.g in case of dispute etc). Those parties act as Independent Controllers for the processing of your data. 
  4. We may also transfer your data to:some text
    1. Website support and management companies.
    2. Social media management companies.
    3. Lawyers, Accountants and other authorized consultants.
    4. Other Group companies with whom we cooperate to fulfil the above purposes.
    5. Any other administrative, judicial or public authority or, in general, any legal or natural person to whom the Company may have a relevant obligation or right to communicate such data under a law or court decision.

The Company has taken all necessary measures to ensure that its staff and partners are specifically authorised for these purposes and are fully bound by the confidentiality and obligations provided for in the legislation regarding the collection and further processing of your data
‍As a rule, Simpler does not transfer your Data to third parties except when clearly required by the current legislative/regulatory framework.

7. How does the Company protect personal data?

Our Company has taken all appropriate organisational and technical measures, in accordance with technological standards and applicable laws and regulations, to ensure that the processing of personal data, whether by itself or by third parties on its behalf, is lawful, appropriate and has an appropriate level of security to prevent any unauthorised or accidental access, processing, deletion, alteration or other use of such data.

‍8. For how long will your data be kept?

The personal data processed by the Company are kept for as long as necessary to fulfil the purpose of each processing operation. At the end of this period, the data will be deleted, unless otherwise specified by law or if this is required to establish, exercise or support the Company's legal claims.

In particular, your data from the registration with Simpler will be kept until you decide to delete your Account.

9. What are your rights?

You have the right to:

  • information about the processing of your personal data;
  • obtain access to the personal data held about you;
  • ask for incorrect, inaccurate or incomplete personal data to be corrected;
  • request that personal data be erased when it’s no longer needed or if processing it is unlawful;
  • object to the processing of your personal data for marketing purposes or on grounds relating to your particular situation;
  • request the restriction of the processing of your personal data in specific cases;
  • receive your personal data in a machine-readable format and send it to another controller (data portability);
  • request that decisions based on automated processing concerning you or significantly affecting you and based on your personal data are made by natural persons, not only by computers. You also have the right in this case to express your point of view and to contest the decision.

10. How can you exercise your rights?

You can exercise your rights by posting the Application form available here and send it either to Simpler's address in London (128 City Road, London, United Kingdom, EC1V 2N) or by email at personaldata@simpler.so. If you hold a Simpler account, you can alternatively use the e-form found here and submit it online.

11. When does Simpler respond to your requests?

Simpler responds to your requests free of charge, without delay and in any case within (1) one month from the time it receives your request. However, if your request is complex or there is a large number of your requests, it will let you know within the month if it needs to receive an extension of another (2) two months to respond to you.

If your requests are manifestly unfounded or excessive, due to their recurring nature, Simpler may impose a reasonable fee, taking into account the administrative costs of providing the information or performing the requested action, or refusing to comply with the request, justifying its answer to you. 13. Does Simpler use automated decision making, including profiling during the processing of your Data?

Simpler may use automated decision-making, including profiling, for marketing purposes or for the performance of a contract with you, where allowed by applicable laws or if based on your consent. However, if the decision produces legal effects concerning you or significantly affects you in a similar way, you have the right to obtain human intervention, express your point of view or to contest the decision based solely on automated processing, including profiling.

‍14. What is the applicable law during the processing of your Data by Simpler?

Applicable Law is the UK Law, as formulated in accordance with EU and UK data protection legislation. Competent Courts for any disputes arising in connection with Your Data are the Courts of London, UK.

15.Where can you go to check if your rights have been respected?

If you do not receive a response within the stipulated deadline (one month with - subject to extension - two months) or the response you receive is unsatisfactory or the issue has not been resolved, you can lodge a complaint with the Information Commissioner’s Office (www.ico.org.uk) or the data protection supervisory authority in the country in which you live or work where you think we have infringed data protection laws.

16. How will you be notified of any changes to this Policy?

Simpler updates this Policy whenever necessary.  If there are significant changes in the Policy or in the way we process your Personal Data, we will publish an update on our website (https://www.simpler.so/) before the changes take effect and we will notify you in any convenient way. Simpler encourages you to read this Policy regularly to know how your Data is protected.
